All content on the Website — including but not limited to texts, photographs, designs, logos, images, videos and source code — is the property of GEM ZOO MADRID S.L. or its legitimate rights holders, and is protected under Spanish and international intellectual and industrial property law.

Reproduction, distribution, public communication or transformation of any such content without the Company’s prior written authorisation is strictly prohibited.

1.4. Liability

The Company does not guarantee the continuous availability of the Website or the absence of errors in its content. The Company shall not be liable for any damages arising from the use of, or inability to access, the Website.

Links to third-party websites are provided for informational purposes only. The Company neither controls nor accepts responsibility for the content of such websites.

1.5. Applicable law and jurisdiction

These terms are governed by Spanish law. For any disputes, the parties submit to the courts of Madrid, expressly waiving any other jurisdiction that may apply to them.

2. TERMS AND CONDITIONS OF USE

2.1. Description of services

GEM ZOO MADRID S.L. is a bespoke jewellery studio specialising in the creation of custom-made jewellery pieces. The Company’s activity consists of designing and crafting personalised jewellery according to each client’s specifications and requests.

The Company does not hold stock and does not conduct online sales. The commission process begins through direct contact with the Company via the channels available on the Website.

2.2. Commission process

The process for commissioning a bespoke piece of jewellery proceeds as follows:

  • The client contacts the Company via the contact form or other means indicated on the Website, setting out their idea or request.
  • The Company evaluates the request and, where applicable, prepares a personalised design proposal and quote.
  • Once the client accepts the quote, the payment terms and production timeline are agreed.
  • Upon completion, the piece is delivered to the client under the terms and conditions agreed between the parties.

2.3. Quotes and pricing

Quotes are prepared on an individual basis for each commission, taking into account the materials, design complexity and production time involved. No price or quote shall be binding until expressly confirmed in writing by both parties.

Prices quoted do not include VAT or other applicable taxes unless expressly stated otherwise.

2.4. Client obligations

The client undertakes to:

  • Provide truthful, accurate and complete information regarding their needs and specifications.
  • Notify the Company as early as possible of any changes to the commission requirements.
  • Make payment within the terms and deadlines agreed.
  • Collect or accept delivery of the piece within the agreed timeframe.

2.5. Design ownership

Designs created by GEM ZOO MADRID S.L. are the intellectual property of the Company. Unless otherwise expressly agreed, the Company may use images of completed pieces in its portfolio and for communication and marketing purposes, at all times respecting the client’s privacy.

2.6. Warranty

GEM ZOO MADRID S.L. offers a lifetime warranty covering all manufacturing defects in pieces crafted by the Company.

This warranty covers exclusively defects originating in the manufacturing process and does not apply to damage resulting from:

  • Misuse or improper handling of the piece.
  • Natural wear and tear over time.
  • Impact, drops, scratches or other physical damage caused by the client.
  • Alterations, repairs or modifications carried out by parties other than the Company.
  • Exposure to chemical agents, excessive humidity or other adverse environmental conditions.

To make a warranty claim, the client must contact the Company through the channels indicated on the Website, describing the defect identified. The Company will assess the case and, if the claim is valid, will repair or replace the piece at no additional cost to the client.

2.7. Returns and complaints

Given the bespoke nature of each piece, returns will not be accepted unless the piece delivered does not correspond to the specifications agreed in writing between the parties.

In the event of non-conformity, the client must notify the Company within 7 calendar days of receiving the piece, using the contact channels available on the Website.

2.8. Limitation of liability

The Company shall not be liable for delays in delivery attributable to force majeure, nor for damages resulting from inaccurate, incomplete or contradictory instructions provided by the client.

3. PRIVACY POLICY AND DATA PROTECTION

3.1. Data controller

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD), the data controller for personal data collected through the Website is:

3.2. Data collected and purposes of processing

The contact form on the Website collects only the information necessary to handle the user’s request (name, email address and description of the enquiry or commission).

3.3. Legal basis for processing
